Rule 49-O. Elector deciding not to vote
Intro
On an average, in every election, nearly 45 % of the eligible voters don't vote at all. For example in the 1999 MP election at north Chennai, the total number of eligible voters are 4.5 crore. Only 2 crore people were voted.
Why people are not voting?
* They feel that nobody is good.
* They may not like the candidate.
* If you see in TN there is only two alliances, one DMK and ADMK. Karunanithi criticizes Jaya and JL complaints about Karuna.
Ultimately the reason for not voting is they don't like the candidates or party.
The candidate require only 30% of cast votes for winning, which is only getting support 16% from the eligible voters.
45 % people don't like them, but 16% people selected.
Now entering into 49 - O
It is a election rule under section 49 - O, which allows a voter to cast a null vote. You can get a form at Polling booth fill it and register that they don't like the candidate. Casting your vote is your right and duty. By casting a null vote you are not violating the rule.
What is the advantage?
It is a unique feature of our Indian constitution that it has provide the legal right to the voter to reject all the candidates. Section 49 O of Election rules in 1961, has empowered this right. If the 45% of the people feel that the candidates are unworthy, the best way to communicate this view to the politcal party is not by their absentism, by filling the form 49 - O. If the number of votes for 49 - O is more than the other candidates vote, the election itself get cancelled. The candiates cannot compete for the next time. So please if you don't like the candidates vote for 49 - O.
The Text
49-O. Elector deciding not to vote.-If an elector, after his electoral roll number has been duly entered in the register of voters in Form-17A and has put his signature or thumb impression thereon as required under sub-rule (1) of rule 49L, decided not to record his vote, a remark to this effect shall be made against the said entry in Form 17A by the presiding officer and the signature or thumb impression of the elector shall be obtained against such remark.
Rule 49-O falls under the Chapter II of Part IV of the Rules which was introduced in 1992 and deals only with voting by electronic voting machines or EVMs. The remark referred to here is an offline entry by the presiding offer (accompanied by the voter’s signature) to record the fact that a vote was not electronically recorded even though the voter had registered in the register of voters. This would allow reconciliation of mismatches arising from a situation where you have lesser votes polled in the machines than the names entered and signed in the register of voters. There is no provision for polling to be cancelled based on the number of 49-O votes.
